TERMS OF USE
Version dated 11 October 2026
1. PURPOSE AND SCOPE
These terms describe the conditions for browsing www.kaneoriginal.com and using its forms. The website is operated by Don Lamino Group (DLG) Sàrl, a company registered in the commercial register of the Canton of Geneva under UID CHE-270.508.210.
The website presents Kane Original, a hibiscus drink, and allows individuals and professionals to contact its operator.
These terms apply to the informational website. The terms of any subsequent sale, delivery or business collaboration are determined separately, in accordance with applicable law and the agreements actually entered into.
2. BROWSING THE WEBSITE
The pages can be viewed without creating a user account. The website has no customer area, shopping cart or payment module.
Visitors remain free to browse the available information and decide whether to contact DLG. Simply browsing the website does not constitute an order, acceptance of a commercial offer or general consent to the use of personal data for advertising purposes.
Information about personal data is provided in the privacy policy. These terms do not replace the specific information or choices required for data processing.
3. CONTACT FORM
The Contact form allows visitors to ask questions about the drink, the information on the website or other matters relating to Kane Original.
Visitors provide an email address at which they can receive a reply and the information needed to understand their enquiry. Optional information should only be provided where relevant.
Submitting the form starts a conversation with DLG. Any acknowledgement of receipt confirms only that the message has been received; it does not constitute acceptance of an order or another commitment requested in that message.
If you encounter difficulties with the form, you can send your enquiry to info@kaneoriginal.com.
4. BECOME A PARTNER FORM
The Become a Partner form is intended for professionals seeking information about reseller packs or considering selling or serving Kane Original at their establishment.
Information about the establishment, its location, anticipated quantities and supply requirements helps us prepare an appropriate response. An estimated quantity provided in this context does not constitute a binding order.
Requesting information, attending an initial meeting and receiving a commercial proposal do not oblige you to place an order. You remain free to accept or decline the proposal.
Contacting us does not confer the status of distributor, representative or exclusive partner. Any collaboration and any rights arising from it must be covered by a separate agreement.
5. POSSIBLE SUBSEQUENT BUSINESS RELATIONSHIPS
If discussions lead to a sale or collaboration, the parties separately agree on the necessary details, including the product, quantities, price, payment arrangements and delivery terms.
A contract is formed through the parties’ agreement under applicable law. The absence of an online shop does not prevent a contract from subsequently being concluded by email or by other means.
If general terms of sale are used for that relationship, they are provided before the contract is concluded and incorporated into it in accordance with applicable rules. These terms of use do not replace those commercial terms.
6. PRODUCT INFORMATION
DLG seeks to present the drink accurately and update the published information when its characteristics change.
The photographs illustrate the product and its presentation. Differences in how screens render the images do not change the stated characteristics of the drink.
Before consuming the product, please consult the label on the specific unit, including the ingredients list, any allergens, the date indicated and storage instructions. If website information conflicts with the label, contact DLG for clarification.
The information on the website does not exempt DLG from its legal obligations regarding accurate product presentation, consumer information and food safety.
7. LAWFUL USE OF FORMS
The forms must be used for enquiries related to the purpose of the website. Visitors must avoid submitting information that is clearly false or impersonating another person.
It is prohibited to use the website to send fraudulent, harassing or unlawful messages, distribute malicious software, attempt unauthorised access to systems or disrupt their operation.
DLG may implement proportionate protective measures, including filtering unwanted messages and limiting abusive requests. These measures comply with the law and do not remove data subjects’ rights regarding personal data protection.
8. INTELLECTUAL PROPERTY
Texts, photographs, illustrations, graphic elements, logos and other content are protected to the extent provided by applicable Swiss law, including copyright and trademark law.
Viewing this content does not transfer any intellectual property rights. Any reproduction, adaptation, distribution or exploitation beyond uses permitted by law requires the consent of the relevant rights holder.
Statutory exceptions, including permitted quotation and private use, remain unaffected.
9. LINKS TO THIRD-PARTY WEBSITES
When a link leads to an external website, including Alive Studio’s website, visitors leave the Kane Original website and access a service operated by a third party.
That third party’s terms of use and data protection rules apply to its own services. A link does not imply that DLG controls all the content or processing offered by the external website.
Clearly unlawful content discovered on a linked page can be reported to DLG so that the link can be reviewed.
10. AVAILABILITY AND MAINTENANCE
DLG takes reasonable measures to keep the website accessible and functioning properly. Access may nevertheless be interrupted or restricted during maintenance, updates, technical incidents or events affecting networks or service providers.
If a message cannot be sent through a form, visitors can use the email address stated in the legal notice.
Technical changes to the website do not affect business commitments already validly entered into outside the enquiry forms.
11. LIABILITY
DLG’s liability is determined in accordance with applicable law and the circumstances of each case.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for wilful misconduct or gross negligence. Mandatory obligations concerning data protection, product safety and consumer protection remain unaffected.
12. UPDATES, APPLICABLE LAW AND CONTACT
DLG may update these terms to reflect changes to the website or applicable law. The version date appears at the top of the page. An amendment does not retroactively change contracts already entered into and does not replace an agreement or consent where required.
Swiss law applies, subject to any applicable mandatory provisions. Jurisdiction is determined by the statutory rules; mandatory places of jurisdiction remain unaffected.
